1. Agreement
By accessing thegemmarketingagency.com or purchasing any service, you agree to these Terms. If you do not agree, please do not use the site.
2. Services & deliverables
Service descriptions, scope, and pricing on the site are accurate at time of publication. The specific scope, timelines, and revisions for your project are confirmed in writing after purchase. We reserve the right to refuse or cancel any project that falls outside our service offering.
3. Payments
All payments are processed securely by Stripe. Prices are listed in USD unless stated otherwise. By submitting payment you authorize the charge shown at checkout, including any applicable taxes.
4. Subscriptions & cancellation
Subscription services (e.g. monthly social media management) renew automatically each billing cycle. You may cancel at any time; you will retain access to the service until the end of the paid month. We do not issue partial refunds for unused portions of a billing cycle.
5. Refunds
Because services begin immediately after purchase (intake, planning, and creative work), one-time service fees are non-refundable once work has commenced. If you believe there is an issue with a deliverable, contact us within 7 days and we will work with you to make it right.
6. Intellectual property
Final, paid-for deliverables are licensed to you for the agreed use. We retain the right to display work in our portfolio unless otherwise agreed in writing. All site content, branding, and templates remain the property of Gem Marketing Agency.
7. Acceptable use
You agree not to attempt to disrupt the site, abuse the contact form, submit fraudulent payments, or use our services for unlawful content.
8. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim related to a service is limited to the amount you paid for that service. We are not liable for indirect, incidental, or consequential damages.
9. Changes
We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
